Please read these Terms of Service carefully before using the NiteCrew mobile application. By creating an account or using the app, you agree to be bound by these terms.
These Terms of Service ("Terms") govern your access to and use of the NiteCrew mobile application ("App") and any related services provided by NiteCrew ("we," "us," or "our"). By downloading, installing, or using the App, you confirm that you have read, understood, and agree to these Terms.
If you do not agree to these Terms, you must not use the App.
You must meet all of the following conditions to use NiteCrew:

NiteCrew is a harm-reduction safety application designed to help users drink more responsibly and make safer choices. Key features include:
IMPORTANT DISCLAIMER: NiteCrew is a harm-reduction tool only. It does not provide medical advice, diagnosis, or treatment. BAC estimates and Walk Test results generated by the App are approximations based on information you provide and are not a substitute for professional blood alcohol testing. They may be inaccurate.

We reserve the right to suspend or terminate accounts that violate these Terms or are used fraudulently.
NiteCrew uses your device's location for specific safety features, including:
By enabling location features, you consent to your location being shared as described. You can disable location access at any time in your device settings, but doing so will limit certain safety features. We do not permanently store GPS history on our servers. You agree to use the App only for lawful purposes and in accordance with these Terms. You must not:
When you participate in Group Sessions or use social features, you acknowledge that:
Night Radar is an opt-in feature. When you activate it, your approximate location is broadcast to friends who are also active on Night Radar. You may deactivate Night Radar at any time. Proximity data is not stored permanently on our servers.
You may send friend requests to other users and manage your friend list. You may block any user at any time to prevent them from seeing your profile or Night Radar status. Block relationships are stored on our servers as part of your account data.
NiteCrew includes social drinking game features and an Achievements system:
With your permission, the App may send push notifications for game invites, friend requests, and Night Radar proximity alerts. You may withdraw notification permission at any time in your device settings or in the app's notification preferences. Your device push token is stored on our servers solely to deliver these notifications.
You are responsible for obtaining consent from any individual you add as a trusted contact. By adding a contact, you confirm that the contact has agreed to receive safety alerts from you via SMS, which may include their name, your location, and a distress message.
All content, features, trademarks, and intellectual property in the App are owned by NiteCrew or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You must not reproduce, distribute, or create derivative works from any part of the App without our express written permission.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NITECREW AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In no event shall our total liability to you exceed the greater of (a) the amount you paid us in the twelve months prior to the claim, or (b) one hundred US dollars (USD $100).
You agree to indemnify and hold harmless NiteCrew, its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the App, your violation of these Terms, or your violation of any applicable law.
We may suspend or terminate your access to the App at any time, without notice, for any reason, including if we believe you have violated these Terms. You may terminate your account at any time by contacting us at daniel@gravity666666.com or by using the account deletion feature in the App's Settings.
Upon termination, your right to use the App ceases immediately. Sections covering disclaimers, limitation of liability, indemnification, and governing law survive termination.
We reserve the right to update these Terms at any time. We will notify you of material changes through the App before the changes take effect. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which NiteCrew operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of that jurisdiction.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
